A2 -> H1B question

I am currently a dependent of an A2 diplomat and I have an employer willing to sponsor an H1B visa for me, which will require us to move and my spouse to eventually leave her job.

In order to apply for an H1B visa now, we need to fill I-566 form, but we have been told that filing this form will stop my spouse's A2 status and her employment at the consulate within 30 days.

Is there a way to apply for an H1B visa while keeping A2 status until Oct. when the H1B visa kicks in?

I am in the same situation with your wife, currently holding an A2 visa and a company is interested in sponsoring me when the new H1B application process starts. I was wondering if you were able to get an answer to your question. Do I have to leave my A2 status until H1B is approved? And what if it's not approved? Then I would have to quit my job and leave the country, which I would not want to do.

sounds like you would need some personal advice for your situation - I would contact an immigration lawyer
