There has recently been a lot of mixed information and confusion on the internet about this years quota of H1B visas being filled already.
We wanted to clarify that this years quota has NOT been filled - it hasn't even started yet.
- Every year, a new quota of 85,000 H1B's can start to be filed from April 1st onwards
- As we are currently only in February, all of 85,000 are still available
- Nobody has one of this years H1B visas, because nobody can even file for one for another 7 weeks
- This years quota is full and open.
- Every year at the start of March the US Government publicly announces that they will start accepting applications for the year
- Every year starting on April 1st, the US Government starts accepting and processing new H1B visa applications
- Every year the US Government accepts, processes and issues a total of 85,000 new H1B visas
- Every year the Government continues to accept new applications until they have processed and issued 85,000 H1B visas
If you're an International professional or student that wants an H1B visa, now is the time to find an H1B sponsorship job with an H1B sponsoring company.
H1B employers (sponsor companies) can start filing H1B visas starting from April 1st, 2011
For H1B employers and job seekers, expect and plan for a busier and faster H1B visa season this year: Private Sector employment increased steadily during 2010. Foreign nationals who want an H1B visa must 1st obtain an H1B sponsorship employment position, with, a US company that will apply for and file their H1B visa application
Because H1B employers can start filing visas in a few weeks they are heavily recruiting and hiring now.

This is the time of year when H1B employers and sponsor companies recruit and select H1B workers
January to March is always the best time of year to obtain H1B sponsorship employment, before filing opens on April 1st
The current quota allocation / number of new H1B visas available that can be issued this year is 85,000
Every year H1B visas are issued on a first-to-apply / first-issued basis
There are 2 exceptions to the above regular H1B visa program rules and regulations:
Anyone that already has a valid H1B visa can file a 'transfer' visa application - for a new H1B sponsorship employment position with a new US employer company - at any time of year. There is no limit, restriction or quota for the number of H1B transfer applications that can be filed during the year
Anyone who obtains sponsorship employment with an H1B 'cap-exempt' US company can file for a H1B visa at any time of year. There is no limit, restriction or quota for the number of cap-exempt H1B visa applications that can be filed during the year

The latest update H1B cap and quota update has been released from the USCIS
H1B visas left over from the H1B visa 2010 cap (quota) are now down to 4,300
85,000 new H1B visas are also available for the H1B 2011 cap
Currently - 4,300 H1B visas can be filed which can still be counted against the 2010 H1B cap.
Visas filed for the 2010 cap can be filed now and can be issued work authorization start dates now.
The remaining H1B visas from 2010 will not last long so it is recommended to apply asap.
H1B transfers, extensions and cap-exempt employment are not counted against the cap numbers
The H1B cap 2011 numbers are 85,000 new H1B visas available for filing this year
